Reflection of Human Rights in Various Legislations in India

The reflection of the Human Rights perspective and quest for the protection of Human Rights can be clearly seen from the way various legislations in India are enacted. The legislations in India are being enacted keeping in mind the goal of protection of Human Rights. All the major labour welfare legislations enacted in India do support strongly to this argument. To cite a few examples here would clear the point. The Equal Remuneration Act aiming at bringing in equality in the amount of wages paid to male and female worker for the same kind of job done. The Juvenile Justice Care and Protection Act which aims at the protection of rights of child in India. A special reference to the international child rights protection instruments in the preamble of the Act points to the fact that protection of rights of child involved in the justice system in India has received the attention in the country. 

The aforementioned are the examples of legislations directly aiming at the protection of Human Rights of one particular group as women in first example and children in the second. There are various legislations which perform the task of Human Rights protection in an indirect way these includes all major ‘environment concerning human activities regulating legislations’ as Air (Prevention of Pollution) Act, Water(Prevention of Pollution) Act, which aims at ensuring the pollution free air and water, ensuring indirectly the right to pollution free environment.

Yet another very important legislation in the field of Human Rights Protection in India is Protection of Human Rights Act, 1993. This Act directly deals with the protection of Human Rights. It also provides for the establishment of the Human Rights Violation Complaint Resolution System. It provides for the establishment of National Human Rights Commission for India (NHRC) and also the State Human Rights Commissions at state level.
