Judicial Interpretation of Article 21:


    The need to devote a complete head for the judicial interpretation of Article 21 is that it is most widely interpreted Article of the Constitution. From the human rights perspective also it is so important because all the efforts done by judiciary to elevate the social, economic rights as fundamental rights have been done by expanding the scope of Article 21 only. The Courts especially the Supreme Court of India has interpreted this Article to include various rights as: 

Right to speedy trial, right to pollution free air and water, right to a fair trial, right to health, right to legal aid, right to livelihood, Right to medical aid, etc. The list is not exhaustive and there are other rights also which have been brought under as a matter of fact the scope of Article 21.
